1. DESCRIPTION OF SERVICES.


By using our services it is very important that you respect intellectual property rights, privacy and rights of others at all times.


2. ACCEPTANCE OF TERMS.


1. Please read carefully these Terms and Conditions ("T&C") involving you and Aumentaty, S.L.; tax residence in C/ Guardia Civil 29, Entpta. B, 46020 Valencia (Spain). By using our service, in any form, media or place, you agree to the T&C and Legal Notices that Aumentaty may present, including the "Method of Detection and Removal", Privacy Policy and all amendments Aumentaty may publish. You should keep the present T&C in a permanent data support for later review and print them before you start using our services.

2. You are only allowed to use the services if you are older than 18 years of age. If you are under 18, please read these T&C with your legal guardian(s) and ask for permission to use this service.


3. USE OF THE SERVICES


3.1. You understand that we are not responsible for any content created by others. The content which you can access to are not considered previously by us, but we reserve the right to remove any content if we believe it is illegal or violates these and /or other T&C. We ask that you alert us if you detect content posted which may be infringing or illegal. You release us from any claims by third parties regarding the content accessed under your account, including manners deemed illegal or harmful.

3.2. You must refrain from any activity that directly or indirectly interferes with or disrupts our services.

3.3. Third Party Content or parts thereof may be protected by intellectual property rights. You may not modify, sell or distribute Third Party Content in any way using our services.

3.4. You may not modify, copy, or create derivative works that are based on our services. You shall not re-sell, trade, rent, lease or distribute our services unless we have expressly agreed otherwise.

3.5. This service may contain links to other sites on the Internet or elsewhere. We have no control over these sites and are not responsible for any information contained in them. We disclaim any responsibility for these sites.

3.6. You are responsible for protecting the security of any content that is stored on the mobile device used to access the services.

3.7. We may suspend permanently or temporarily the provision of the services or parts thereof without notice if circumstances require us to.


4. COSTS, PRICES AND PAYMENTS


You agree that you are solely responsible for all costs related to the use of these services, such as communication costs for mobile devices, mobile Internet and roaming, and taxes.


5. INTELLECTUAL PROPERTY RIGHTS


5.1. Aumentaty or its licensors own all rights and title to these services. Unless agreed otherwise and expressly permitted, you may not reverse engineer, decompile or attempt to decompile or otherwise extract the source code of the software Aumentaty or its licensors provides.

5.2. Unless we have agreed or specify guidelines that allow it, you are not allowed to use the logo Aumentaty, Aumentaty, or any other trademark, service mark, graphic and logo used by Aumentaty or its licensors in connection with the services.

5.3. We grant you a personal, universal, temporary, non-transferable, royalty-free nonexclusive right to use the software we offer.


6. LIABILITY AND WARRANTIES


6.1. You understand and agree that the services are provided "as is" and in an "as available" basis. Aumentaty rejects warranty of any kind, either expressed or implied, including warranties:
(I) that the services will be error free or that access to them is uninterrupted
(II) that the content or other information obtained through the services are accurate and reliable.

6.2. You agree that neither Aumentaty, its affiliated companies, suppliers nor its licensors are liable for any damage or loss may be incurred by you in connection with your use of the service. Unless the extent of the damage is the direct result of intent or gross negligence by Aumentaty, Aumentaty accepts no liability for damages, lost profits or data, direct, indirect or consequential or otherwise arising in connection the service, even though Aumentaty or its affiliates, suppliers or licensors have been informed or were aware of the possibility of such damages. In any case, the maximum aggregate liability of Aumentaty, its affiliated companies, suppliers or licensors for damages arising from the service will refund the amount paid by you to Aumentaty, if any.

6.3. Usted manifiesta y garantiza que:
(I) The use of the service that you use will be in strict compliance with the instructions Aumentaty provides and all applicable laws and regulations (including any local law or regulation, regarding the conduct, content and transmission of acceptable technical information "on-line").
(II) You agree you will not infringe or misappropriate the intellectual property rights of third parties. You release us from responsibility for any claims, including reasonable attorneys' fees, resulting from your use of the services, and the content that you post.


7. TERMINATION


7.1. You can always terminate your use of the services.

7.2. Aumentaty has the right to terminate the agreement with you, in whole or in part, if:
(I) you breach any provision of these T&C;
(II) Aumentaty is obliged to do so by law or by an order of any competent authority;
(III) Aumentaty decides the discontinuance of the services.

7.3. You understand and agree that upon termination of the agreement, you will have to stop using the services immediately and remove the content in any device that you have been using.

7.4. All provisions are to be kept in place after completion of service, either naturally or because it is expressively provided in these T&C or any other agreement with you. These provisions include, but are not limited to, the provisions relating to intellectual property, warranty exclusions, indemnity and limitations of liability and applicable law.


8. MISCELLANEOUS


8.1. These T&C and use of the services are governed by the laws of Spain. Disputes relating to it will take place before the court in Valencia, Spain.

8.2. If any provision of the T&C is held invalid or unenforceable, that provision will be interpreted to reflect the original intent of the parties. Despite the invalidity or unenforceability of that provision, all other provisions shall remain in full force and effect.

8.3. You agree that if Aumentaty doesn't exercise or enforce any right or action, that this does not waiver Aumentaty's rights

8.4. Aumentaty reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time.
